We note the resolution from our London Transport Regional Council regarding the company going outside of their own procedures to intimidate and mis-discipline our members.

We instruct the General Secretary to pace a report in front of this NEC without delay.

BREAKDOWN IN INDUSTRIAL RELATIONS, TRAIN OPERATORS, VICTORIA LINE - LONDON UNDERGROUND (LUL/14/2)

I advised you previously that the NEC had instructed me to obtain a report from the Regional Organiser with regards to the local meetings that were taking place that would hopefully resolve this dispute over the need to improve working relationships between RMT members and Victoria Line management (Ref: IR/399/19, 2nd October 2019).

Subject: DISMISSAL, MEMBER, CSA, PICCADILLY CIRCUS AREA – LONDON UNDERGROUND

That we note the resolution and share the concerns of our Bakerloo Line Branch around the arbitrary discounting of evidence and severity of sanction in comparison to
similar cases.

We therefore instruct the General Secretary to pursue the following course of defensive actions should our member’s coming appeal not result in his reinstatement; in line with the resolution:

That we note the resolution from our TfL No1 & LUL MATS Grades Branch; and instruct the General Secretary to issue an urgent yellow RMT circular reminding all applicable London Underground staff of the RMT position regarding the LUL Attendance at Work policy.

Also restating previously issued advice relating to associated LUL paperwork that staff may be asked to sign.

RMT train driver Mulu Tumzghi faced termination at CDI following a SPAD in Neasden depot. The RMT went into dispute and fought his case and now this unnecessary disciplinary has been thrown out. Mulu is back at work as a train driver because he is a member of the RMT, the train drivers union.

Mulu should never have faced a a disciplinary charge: his was not an aggravated SPAD. Mulu was honest about what happened and followed instructions as soon as he was aware of his error.

DOWNGRADING, A. MORGAN, TRAIN OPERATOR, NEASDEN TRAINCREW DEPOT - LONDON UNDERGROUND

Further to my previous Circular (IR/211/19, 23rd May 2019), where I advised that Brother Adrian Morgan had been downgraded to a CSA2, I am pleased to report that following a successful appeal, our member has now been reinstated to his substantive post as a Train Operator. The National Executive Committee has congratulated the Lead Officer, Representatives and Neasden Branch for their hard work in achieving this positive result

Jubilee line driver Mulu has been put through an unfair and unnecessary disciplinary process following an incident in work.

The attached newsletter explains precisely what happened, why the disciplinary is wrong and what the RMT is preparing to do to defend our member.

An RMT National Executive Committee decision is due imminently so an update will be ready soon.

COMPANY DISCIPLINARY INTERVIEW (CDI) FOLLOWING SPAD, JUBILEE LINE

LONDON UNDERGROUND (LUL/4/4)

RMT Jubilee South branch has unanimously voted in support of a motion that highlights the branch support for a Tube driver who is facing an unnecessary disciplinary process.  Branch members felt that the matter had been dealt with badly and that, as the motion states 'should [the driver] receive any penalty at disciplinary we will consider what further action we will take to defend and support this driver.'
