London Underground Cleaning contracts go to ABM

TUPE TRANSFER OF LONDON UNDERGROUND CLEANING CONTRACT TO ABM

I write to advise you that London Underground has awarded its cleaning contract to a company called ABM. This new company will manage all cleaning across London Underground and approximately 3000 staff will be TUPE transferring across to the new employer.  We have been informed that Interserve and Vinci staff will transfer over on 17th September 2017 and ISS (JNP) staff will transfer on 31st December 2017. RMT is involved in discussions with ABM over the transfer and we will keep you informed of developments.

What is TUPE?
TUPE (Transfer of Undertakings and Protection of Employment) is a legal process that protects workers when a company loses a contract and the staff transfer across with the work to a new employer. Under this process you will begin working for APM on the transfer date outlined above but you will remain on your current terms and conditions, keep your length of service and RMT will still be the Trade Union that represents you. The employers are required to consult with us as the recognised Trade Union for the affected workers to ensure the transfer is conducted in a proper manner. Please be assured your existing terms and conditions will be protected and should only be changed by agreement with your Union.

We have recently received information that some staff are being contacted by APM and have been offered new contracts of employment. Any new terms and conditions should only be discussed with your union and we are taking this issue up with your employer as this should not be happening. Members are urged not to sign any new contracts or terms and conditions until RMT has the opportunity to discuss this with your company on your behalf.
