Forced Transfer of Staff

The Local Transport Act 2008 gained royal assent in November 2008. It enabled the creation of Integrated Transport Authorities in the UK modelled on TfL, allowing these authorities to award Quality Contracts. Most of the Act doesn't affect London's bus workers.

However, section 44 of the act amends TUPE rules for those staff on particular Quality Contract routes which are lost by one company and awarded to another. It allows for the transfer of those staff from one company to another. This is causing a great deal of anger, stress and despair as many drivers do not want to move garages or change employer. Some transfers have already taken place. Others are imminent such as routes 10 and 414 drivers from First's Westbourne Park garage.

The RMT is seeking legal advice.
