Tribunal Verdict: LU Dismissed Arwyn Thomas Unfairly

RMT General Grades Committee decision:

That we note that the Employment Tribunal has ruled that London Underground dismissed Arwyn Thomas unfairly. This proves beyond any doubt what this union has asserted all along – that Arwyn’s sacking was a great injustice.

We further note the Tribunal's finding that “no reasonable employer would have taken this action in these circumstances...”

This injustice can only be put right by Arwyn's return to work for London Underground, not by a pay-off. Our reps are not for sale.

We note that the GS is seeking a meeting with the Managing Director of London Underground to make arrangements for Arwyn's return to work.

We congratulate Arwyn, our legal team, our representatives and our members, whose steadfastness and hard work has brought us to this strong position.

Our strike action next week will go ahead unless and until LU agrees to Arwyn's return to work.

We instruct the General Secretary to:
• Report back to us on the progress of talks
• Continue to seek the fullest media coverage for this union's stance on this issue and the facts of the case.
• Send a letter to all London Underground members advising them of the situation.

London Transport Regional Council and branches with London Underground members to be advised.

What is a National Executive Committee decision?

This article is an 'executive decision' which has been written by the RMT National Executive Committee. The National Executive is the union's governing body in between AGMs. Its decisions set out what the union will do on a particular issue.

These decisions can often be brief, and may be one of several passed over a period of time. To get a better understanding or find out more information about what the RMT is doing, speak to your rep or attend your branch or Regional Council meeting.
