What is a National Executive Committee decision?

RMT Denounces LU's Ban on Regional Organiser

That we note the unjust conviction of our London Transport Regional Organiser. This conviction is a clear miscarriage of justice and an attack on our union; by London Underground's own admission, it resulted from an incident that took place while Brother Hedley was carrying out his union activities.

We further note that London Underground has seized on this situation to ban our Regional Organiser from its premises and even to demand that this union allocate duties to our Regional Organiser which prevent him having any contact with any LU employees, which includes thousands of our members.

Our members in the London Transport Region elected their Regional Organiser and are entitled to be represented by him both collectively and individually. This union does not choose or veto who employers choose to send as their representatives to meetings with us, and we do not accept that employers have the right to choose or veto who this union chooses to send as our representatives.

The rule book indicates that our members must be represented. The law also provides for employees to be represented by a representative or official of their choice. We therefore instruct the General Secretary to insist that where a member chooses to have Brother Hedley as his/her representative at a disciplinary or grievance hearing, London Underground (and any other employer) must allow this, convening the hearing away from company premises if necessary. Should the employer obstruct this, legal action should be initiated.

We endorse the General Secretary's action in directing representatives to carry on meeting management for negotiation and consultation purposes, with Brother Hedley being in the vicinity of the meeting to provide guidance.

This matter to be placed back in front of us in the event of further developments.
