LU Skills Development Staff TUPE update

TUPE TRANSFER OF LU SKILLS DEVELOPMENT STAFF INTO TFL (LUL/15/10)

The London Transport Regional Council submitted the following resolution:

"This region notes that:

  • The management at TfL are currently undertaking a TUPE of LU Skills Development staff into TfL
  • That same management are currently undertaking a reorganisation of the TfL area the staff will be moving into
  • That only one MATS RMT rep is being released for this consultation when the usual standard is the release of all 5 MATS RMT reps. Management are doing this through a loophole where if a TUPE affects both MATS and MM grades, they can use less MATS reps for consultation
  • That staff are being demoted and are entering above the top of the new pay band
  • That many LU staff being TUPEd will now be paid over the top of the band and will only receive non-consolidated pay rises for the rest of their time at the company
  • The staff being TUPEd are being moved into an area without local RMT recognition

The TUPE process will be concluding shortly

This region believes that:

  • This is not a meaningful consultation process as our reps have not been released as usual for consultation
  • This TUPE process is an attempt to push down the pay and pensions of RMT members
  • This TUPE process will remove local RMT representation for those staff
  • This TUPE should be halted immediately

This region resolves that:

  • The NEC informs the Regional Organiser to instruct the company to engage into full and meaningful consultation on any process affecting these staff and to fight for the prevention of any demotions
  • The NEC inform the General Secretary to send a letter to TfL requesting that they stop the TUPE of LU Skills Development staff immediately
  • The NEC inform the General Secretary that we wish to enter into dispute on this matter"

The National Executive Committee has considered this matter and taken the decision to seek an updated report from the Lead Officer. I will keep Branches advised of all further developments.
